Before construction begins on the second stage of the Hurstbridge Line Upgrade, the Level Crossing Removal Project (LXRP) is required to have a range of approvals in place, including those relating to planning.

In January 2020, LXRP started a planning approval process to amend the Banyule, Darebin, Nillumbik and Yarra Planning Schemes.

The community and stakeholders in the area were given an opportunity to share what was important to them and submit feedback on the project and relevant planning matters.

During the submission period, the Minister for Planning introduced a new Particular Provision, Clause 52.03 Level Crossing Removal Project into all planning schemes across Victoria. This new provision removes the need for separate planning scheme amendments or planning permits for LXRP projects.

Considering this change, LXRP will no longer seek to amend the Banyule, Darebin, Nillumbik and Yarra Planning Schemes, as the Hurstbridge Line Upgrade will now proceed under the new provision.

LXRP will still address similar matters to those ordinarily covered by the previous planning approval process. For example, before starting construction, LXRP will be required to obtain approval for:

  • a consultation summary report explaining LXRP’s consultation approach and how feedback was considered
  • an Environmental Management Framework (EMF)
  • a plan showing the boundary of the area where works will occur.

All feedback already received by LXRP during the public consultation process on this project remains valid and will be included in the public consultation summary report submitted to the Minister for Planning, to inform the assessment process.

No further submissions will be required as a result of the change in the planning approval process.

There will be further opportunities for the community to provide input into the project as it progresses and these will be promoted online through the Level Crossing Removal Project website and in the community.
